The guidelines outlined in the G.O.Ms govern the state’s private managements. No. 1, Education (PS.2) Department, dated January 1, 1994, for the grant of permission for the establishment of schools, the improvement of already existing schools, the recognition of schools, and the disciplinary control of school employees.
The Right of Children to Free and Compulsory Education Act of 2009 was subsequently enacted by the Indian government, and the Government of Andhra Pradesh issued G.O.Ms in response. No. 20, Department of Education (P.E.PROG.I), dated March 3, 2011.
Additionally, the government has issued G.O.Ms. No. 40, Department of Education (SE.PS.I), dated: 18.06.2013 by establishing guidelines for teacher rationalization in private management. Considering the stay allowed on the activity of expressed G.0 by the Hon’ble High court in W.P.No. 25319 of 2013 and its cohort, for which the Hon’ble High Court initially granted an interim suspension on August 13, 2013. As a result, the teacher-to-pupil ratio outlined in Rule 10(12) has been observed to this day. However, on December 14, 2022, WP.No.25319 of 2013 was declared successful and closed.
The G.O.Ms. regulations No. 1, Education (PS.2) Department was established on January 1, 1994, prior to the passage of the Right of Children to Free and Compulsory Education Act, 2009. Because the RTE Act applies to all children, the Commissioner of School Education has recommended and submitted a proposal for the implementation of the schedule outlined in Sections 19 and 25 of the Act.
The Commissioner of School Education has proposed implementing the Right to Education Act in Private aided Management schools, as mentioned in reference 6 above.
In light of the proposition presented by the Magistrate of School Training and according to the standards recommended under RTE Act, Government have chosen to legitimize supported educator posts in the confidential helped schools properly as far as the standards and Timetable endorsed in Segment 19 and 25 of the Right to Training Act.
Consequently, overriding the G.O.M.-issued orders No. 40, Dept. of Education (SE.PS.I), dated June 18, 2013, Government grants permission to the Commissioner of School Education to conduct rationalization in Aided schools within the District and the identification and transfer of surplus teachers to the needy aided schools for the purpose of processing the rationalization of Aided teacher posts. According to the Annexures attached to this G.O., the Competent Authority shall submit a proposal to the Government for the obtaining of a clearance certificate to permit the institutions to fill the sanctioned vacant aided teaching posts. The following guidelines shall be adopted for the rationalization of the services of teachers working against Grant-in-aid posts in private aided Schools: – If there is not a surplus of teaching staff available, the Competent Authority shall:
1. The current rationalization will not result in an increase in the number of Grant-in-Aid positions at a private aided school.
2. Posts will not be transferred between schools under the current rationale.
3. Under the condition that an equal number of Sanctioned Aided Posts (SAP) are vacant in the needy school within the District, only surplus teachers will be permanently transferred to other needy schools.
4. Each private aided school’s teacher needs will be determined by the District Educational Officer using the staff pattern guidelines in Annexure, with the possibility of adopting the UDISE for that particular academic year.
4. The UDISE data are the sole basis for the teacher’s requirements at that particular school or institution.
5. The rationalization exercise will focus on HM, S.A. (Maths), S.A. (Science), S.A. (Humanities), S.A. (1st Language) and SA(2nd Language), SA(PE), SGT, PET, L.Ps, C.I.D.M./Music, etc., in Upper Primary Schools and High Schools. taking on the staff design standards in Annexure.
6. When a rationalization exercise in accordance with these guidelines calls for the transfer of an excess teacher from one school to another, the first step is to obtain the options of the willing teachers in the affected school. If that fails, the transfer will begin with the junior most in the relevant post category in that school.
7. If a post category includes two or more subjects, such as SA(Sci), SA(Maths/Science), SA(Humanities), etc., The subject’s junior majority must be identified as surplus.
8. According to RTE guidelines, the following types of teachers will be considered surplus teachers in a school for the purpose of rationalization: aided teachers working in a primary school with fewer than 30 students enrolled in I-V classes, provided that a government-managed, aided, or upper primary school already exists in the same community and is within safe walking distance of one kilometer.
If there are aided teachers employed in an upper primary school with fewer than 35 students enrolled in VI to VII classes (for the upper primary stage), there is already a government-run or aided upper primary school in the same community, and it is within safe walking distance of 3 kilometers.
There is already an aid-taught high school in the same neighborhood that is managed by the government and has less than 75 students enrolled in classes from VI to X. It is within safe walking distance of 3 kilometers.
Aided Teachers of already closed schools and zero enrollment schools, if any, including all aided teachers who are drawing a salary from the school but working in other schools, shall be worked out in accordance with Annexures to this General Order if there is an excess of aided teachers working in the said school or institution.
As a result of this rationalization, if a aided position at any institution becomes surplus, the position will be eliminated upon the incumbent’s transfer to another aided institution, which will take effect on the date of the transfer.
9. The Regional Joint Director of School Education is the competent authority for High school teacher vacancies, and the District Educational Officer is the competent authority for Primary and Upper Primary schools.
shall allow the aided management to fill all aided positions according to the O.Ms.-required selection procedure. Education, dated No. 1. on January 1, 1994, and in accordance with the Schedule outlined in Sections 19 and 25 of the RTE Act of 2009.
In the future, whenever positions become vacant, the concerned aided management will be required to submit applications to competent authorities;
Within four (four) weeks of the application date, the competent authorities must notify the management or institution of the availability of qualified surplus staff and allocate said surplus staff on a permanent basis.
If there isn’t enough staff, the responsible authority should let the management or institutions know and give them permission to fill the positions in accordance with the rule above, preferably within two months.
